TERMS & CONDITIONS

These Terms & Conditions apply to all quotes, bookings, services and projects provided by Rock on Rock Walls. By accepting a quote, paying a deposit or allowing work to commence, the client agrees to these terms.

ROCK ON  ROCKWALLS - LEGAL DISCLAIMER

QUOTES

All quotes are based on the information available at the time of assessment and remain valid for the period stated on the quote.

Quotes may be revised if:

  • The project scope changes.

  • Site conditions differ from what was originally disclosed.

  • Additional labour, equipment or materials are required.

  • Supplier or material costs change before acceptance.

  • Access to the work area is restricted or unsuitable.


Any additional work outside the accepted quote will be discussed with the client and may incur additional charges.
 

DEPOSITS & BOOKINGS

A deposit may be required before materials are ordered or a project date is secured.

The booking will not be confirmed until the required deposit has been received.

Deposits may be used to cover scheduling, administration, materials, supplier costs and preparation work. Deposits are generally non-refundable once materials have been ordered, labour has been scheduled or work has commenced.
 

Payment terms will be outlined on quote or invoice.

Final payment is due by the date stated on the invoice. Progress payments may be required for larger or longer projects.

Rock On Rock Walls reserves the right to pause work where an invoice remains unpaid.

The client may be responsible for reasonable costs associated with recovering overdue payments.
 

PAYMENTS

VARIATIONS & ADDITIONAL WORK

Any changes requested after the quote has been accepted may be treated as a variation.

Variations may affect the total project price, material requirements and completion timeframe.

Where possible, Rock On Rockwall's will seek approval before carrying out additional work. However, urgent work required to protect the site, structure, workers or surrounding property may be completed where reasonably necessary.
 

SITE ACCESS & CLIENT RESPONSIBILITIES

The client must provide safe and reasonable access to the project area.

Unless otherwise agreed, the client is responsible for:

  • Ensuring the work area is clear and accessible.

  • Providing accurate information about underground services, boundaries and site conditions.

  • Obtaining required owner, strata, council or neighbour approvals.

  • Keeping children, pets and unauthorised persons away from the work area.

  • Providing access to water or electricity where reasonably required.


Rock On Rock Walls is not responsible for delays or additional costs caused by restricted access, undisclosed site conditions or incorrect information provided by the client.
 

UNDERGROUND SERVICES & EXISTING STRUCTURES

The client must disclose any known underground pipes, drainage, wiring, irrigation systems or other services near the work area.

Rock On Rock Walls will take reasonable care but is not responsible for damage to undisclosed, incorrectly marked or undocumented underground services.

Existing walls, structures, landscaping and surrounding areas may be affected where access or excavation is required. Any known risks will be discussed where reasonably possible.
 

MATERIALS

Natural stone, rock and similar materials may vary in colour, texture, shape and size. These natural variations are not considered faults or defects.

Material availability may depend on suppliers. Where a selected material becomes unavailable, Rock On Rock Walls may recommend a reasonable alternative for the clients approval.

Unused materials purchased specifically for a project may remain the property of Rock On Rock Walls unless otherwise agreed in writing.
 

PROJECT TIMEFRAMES & DELAYS

Estimated start and completion dates are provided as a guide only.

Work may be delayed due to:

  • Rain, extreme weather or unsafe conditions.

  • Supplier or delivery delays.

  • Material Availability.

  • Equipment breakdown.

  • Site access issues.

  • Unforeseen ground or structural conditions

  • Council, utility or third-party delays.

Illness, emergencies or circumstances outside reasonable control.

​Rock On Rock Walls will communicate significant delays where reasonably possible but is not responsible for losses caused by circumstances outside its control.
 

PROJECT TIMEFRAMES & DELAYS

Rock On Rock Walls aims to complete all work with reasonable care, skill and professional workmanship.

The client must notify Rock On Rock Walls as soon as possible if they believe there is an issue with the completed work.

Rock On Rock Walls must be given a reasonable opportunity to inspect and, where appropriate, repair or resolve the concern before the client engages another contractor.

Damage caused by misuse, neglect, movement, drainage issues, natural ground conditions, sever weather, unauthorised alterations or work completed by another person may not be covered.
 

DRAINAGE, GROUND MOVEMENT & NATURAL CONDITIONS

Rock Walls & landscaping structures may be affected by soil movement, water flow, erosion, tree roots, extreme weather and other natural conditions.

Unless drainage work is specifically included in the quote, the client remains responsible for maintaining suitable drainage around the completed structure.

Rock On Rock Walls is not responsible for damage caused by poor drainage, flooding, erosion, unstable ground or conditions outside the agreed scope of work.
 

CANCELLATIONS

Cancellation requests must be provided as soon as possible.

If a project is cancelled after materials have been ordered, labour has been scheduled or work has commenced, the client may be responsible for:

  • Materials already purchased

  • Supplier or delivery charged

  • Labour already completed

  • Administration and preparation costs

  • Restocking or cancellation fees.

  • Any others reasonable costs already incurred.


Refund eligibility will be assessed in accordance with the Rock On Rock Walls Refund and Cancellation Policy and Australian Consumer Law.
 

OWNERSHIP OF WORK & MATERIALS

Materials and completed work remain the property of Rock On Rock Walls until all outstanding invoices relating to the project have been paid in full, where permitted by law.
 

PHOTOGRAPHY & MARKETING

Rock On Rock Walls may photograph completed work for business records, website content, portfolios and social media.

Personal information, house numbers, vehicle registration numbers and identifiable client details will not be intentionally published without permision.

Clients may request in writing that their project not be used for marketing purposes.
 

LIMITATION OF LIABILITY

To the extent permitted by law, Rock On Rock Walls is not responsible for indirect or consequential losses arising from delays, interruptions, third-party work, natural conditions or circumstances outside its reasonable control.

Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies that cannot legally be excluded under Australian Consumer Law.
 

PRIVACY

Personal information collected during enquiries, quotes and projects will be used to communicate with the client, prepare documentation, provide services and manage payments.

Information will not be shared with third parties unless required to complete the project, recover payments, comply with legal obligations or where permission has been provided.
 

GOVERNING LAW

These Terms & Conditions are governed by the laws of New South Wales, Australia.

Any dispute will first be addressed through reasonable communication between Rock On Rock Walls and the client before further action is considered.
 

Acceptance

By accepting a quote, paying a deposit or allowing work to commence, the client confirms that they have read, understood and accepted these Terms & Conditions.
